Divorce Mediation

In many cases, your divorce lawyer will recommend you attempt mediation before pursuing litigation. This is due to many factors. First, divorce mediation is the easiest and least stressful way to get divorced, particularly if there are minimal assets to separate and the divorce is amicable. In divorce mediation, a neutral third party (your divorce attorney) will attempt to find common ground between you and your spouse. From that common ground, they will work towards developing a deal both parties are happy with. Both parties will be required to disclose all assets and debts, but they will be able to retain a level of privacy that you don't find in a courtroom. This is a more relaxed, faster process than litigation. If there are children involved, divorce mediation is often better as it allows you and your spouse to maintain a more effective parenting relationship, as there is typically less animosity in a mediation.

Divorce Litigation

If mediation is unsuccessful, the next step is litigation. This is the more difficult and severe option, and both parties will need their own divorce attorney. Prior to going to court, your divorce lawyer will work with the other lawyer in an attempt to negotiate a deal that prevents going to court. However, should they fail to strike a deal, your divorce lawyer will help prepare you for the rigors of a trial. Once in the courtroom, your attorney will ensure that strict protocol is followed so you can end up with the best possible result.
